Are you one of those landlords they are targeting? The answer is yes if you own property that was built before 1978 and your property has NOT been inspected and certified as lead safe per city of Cleveland Ordinance – 747-2019.
The ordinance states EVERY rental unit in the city of Cleveland will have to be inspected beginning March 1, 2021!!!
The ordinance also states – “landlords will have to hire private inspectors”. All properties will have to be certified as lead – “Violations will carry civil and criminal penalties.”
Here’s just some of what lawyers are advising tenants to do – “If there is any peeling paint, large patches of bare dirt on the premises, request that your landlord make repairs. If your landlord fails to make repairs within 30 days, apply to the court to order the landlord to make repairs to lead hazards.”
One of the most common sources of lead contamination is DUST! Yes, something as simple as dust, that can be a result of the tenant moving their furniture across the floor!

Under the ordinance, once an inspector determines that any lead hazards in a unit are mitigated or abated the owner would receive a lead-safe certification that is valid for two years.
Something to keep in mind, the lead hazards are going to be subject to the inspectors’ prejudices and opinions.
